By booking or receiving any service from Repair Gizmo, you (“Customer,” “you,” or “your”) acknowledge, understand, and agree to the following Terms & Agreement / Disclosure. These terms are binding under the laws of the State of New York.
1. General Service Agreement
- Repair Gizmo provides residential and commercial appliance repair services on an “as-is” and “as-available” basis.
- By booking a service appointment, the Customer confirms that they are the legal owner, tenant, or authorized agent of the property where the appliance is located.
2. Limitation of Liability
- Repair Gizmo and its employees, contractors, and affiliates are not liable for any incidental, indirect, or consequential damages, including but not limited to: property damage, data loss, spoiled food, water damage, electrical issues, or business interruption caused before, during, or after service.
- Repair Gizmo does not guarantee that an appliance will be repairable, or that any service performed will restore the appliance to full working order in every case.
- Any warranties or guarantees are limited only to what is expressly stated in writing at the time of service. No verbal representations shall create liability for Repair Gizmo.
3. Replacement Parts & Filters
- Repair Gizmo is not obligated to stock or provide specific replacement parts, filters, or accessories for any appliance make or model at the time of service.
- If a required part is unavailable, the Customer understands it may result in a delay until such part can be ordered, shipped, or obtained from third-party vendors.
- Any part orders are subject to manufacturer and distributor availability. Repair Gizmo is not responsible for delays, defects, or discontinuation of parts by third-party suppliers.
4. Customer Responsibilities
- The Customer must provide safe and reasonable access to the appliance and work area.
- The Customer must disclose any known issues such as leaks, electrical hazards, gas connections, or prior repairs.
- The Customer acknowledges that repairs may require temporary disconnection of water, gas, or electrical services, which may interrupt appliance use.
5. Service Completion & Payment
- All services must be paid in full upon completion unless otherwise agreed to in writing prior to the appointment.
- Estimates provided are subject to change if additional labor, parts, or safety measures are required.
6. No Guarantee Against Future Failures
- Appliance repair is not an exact science. Successful repair of one issue does not guarantee that additional, unrelated issues will not arise in the future.
- Repair Gizmo is not responsible for pre-existing damage, hidden defects, manufacturer recalls, or natural wear-and-tear beyond the scope of the specific repair.
7. Indemnification
By accepting service, the Customer agrees to indemnify and hold harmless Repair Gizmo, its employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, or expenses (including legal fees) arising out of or related to services performed.
8. Governing Law
These Terms & Agreement are governed by and construed under the laws of the State of New York. Any disputes shall be resolved in the appropriate courts located in New York County, NY.
9. Acceptance of Terms
By scheduling, booking, or receiving services from Repair Gizmo, the Customer confirms they have read, understood, and accepted these Terms & Agreement / Disclosure.
